Nintendo started a legal fight over the trademark, and according to the owner presented hundreds of legal documents. But finally, in December, the Costa Rica National Registry dismissed Nintendo's claim due to a missing classification in their trademark. Now this small business officially owns the Super Mario trademark for grocery stores.
